Old Lyme Board of Selectmen
Regular Meeting July 1, 2002

The Board of Selectmen held its regular meeting on Monday, July 1, 2002 at 7:30 P.M. at Memorial Town Hall Auditorium.  Those present were First Selectman Timothy Griswold, Selectman Tom Bice and Selectman Skip Sibley.

1.  Approval of Minutes:                                                                                        
 Selectman Bice made a motion to approve the minutes of May 17, 2002 and June 17, 2002 as written.  First Selectman Griswold seconded the motion.  SO VOTED.

2.  Communications:                                                                                                           
 a.  Atty. Gen. Blumenthal – Local Smoking Regulations
A letter was received from Connecticut Atty. Gen. Richard Blumenthal thanking the Selectmen for supporting legislation that would allow municipalities to regulate smoke in public places even though the General Assembly did not pass the legislation.  

b.  General Code – Update on Ordinance Codification
The town is going through a codification of the ordinances, which is a process to organized and properly index the town ordinances.  The finished work will be available to the public prior to a future town meeting at which time they will be presented for approval.   

c.  Old Lyme Rowing Association – Use of Town Truck
Each year the Old Lyme Rowing Association requests the use of a town truck to transport the rowing shells to regattas during the summer.  The Selectmen authorized the use of the town truck to the Rowing Association during the summer of 2002.

d.  Town Hall Open Friday, July 5, 2002
A reminder that the Old Lyme Town Hall will be opened on Friday, July 5, 2002.

3.  Appointments:
None          

4.  Old Business:
a.  Gary Yuknat, Shoreline Sanitation – New Refuse Container Implementation
During the budget process, the Board of Finance and the Board of Selectmen have worked on a new trash receptacle program known as the Automated Handling System. The driver will no longer have to get in and out of the truck while collecting trash. The new system will allow the driver to manipulate the truck to automatically pick up a standard size container, dump it in the back of the truck, and return the container to the ground. Gary Yuknat, president of Shoreline Sanitation which handles the town’s refuse collection, stated that the growing population in town would eventually mean more trucks and personnel without adopting this automation.   Each household will be given a standard size container at no cost and extras will be for sale for those who need them.                                                                                                                                                                         
There is a 10-year unlimited, non-prorated warrantee on the parts.  Private service is available for a fee of $10 per month.  Selectman Sibley said he was concerned about the weight of the 95-gallon can being moved by certain citizens.  Gary said there are two other sized containers; one is a 60-gallon and the other a 30-gallon container.  First Selectman Griswold suggest that, at the next town forum in August, Gary could have containers there for the public to see.  

b.  Sound View Task Force – Status
The next meeting of the Task Force will be on July 10, 2002 at 7:00 P.M. at Cross Lane Fire Station.  Selectman Bice stated they are working on a proposed PDD Ordinance. and had a preliminary review from CRERPA. Linda Krause, who had extensive comments, is on vacation until July 23, 2002.  She has proposed to meet with the Task Force and the Economic Development Commission separately to discuss some of her recommended changes.      

c.  DSL Service from SNET – Status
The next step regarding DSL service from SNET is to mail a letter with a reply card to citizens within the potential DSL service area requesting whether or not they would buy the service at $50 a month.  If 170 people subscribe, SNET will have cause to move forward with the service.

5.  New Business:
a.  Lt. Gov. Rell – Lyme Art Assoc. Proclamation Monday, July 8, 2002 at 4:30 PM
The Lyme Association has a show commemorating the 100th Anniversary of the first show of the Lyme artists.  Lt. Gov. Rell agreed to attend the show on July 8, 2002 and will read a proclamation from Governor Rowland about the exhibit.

b.  Florence Griswold Museum Grand Opening Krieble Gallery July 2, 2002
The Florence Griswold Museum will have a grand opening of the Krieble Gallery on July 2, 2002 at 9:30 A.M.  

c.  Interim Health Care – 20th Anniversary
First Selectman Griswold attended a 20th Anniversary of the Interim Health Care.  Linda Camarra is the Old Lyme visiting nurse.

d.  Town Forum  – Middle School Auditorium
First Selectman Griswold suggested that the Town Forum could be held on Wednesday, August 21, 2002.  Selectman Sibley had a conflict on that date.  The date of Wednesday, August 14, 2002 was agreeable with the Board of Selectmen.  This will be held in the Middle School Auditorium at 7:30 P.M.  

e.  Sound View Beach Assoc. Parade – Saturday, July 6, 2002 at 10:30 A.M.
The Sound View Beach Association will have its Annual Independence Day Parade on Saturday, July 6, 2002, at 10:30 A.M.

f.  Reimbursement of Miami Beach Assoc Removal of Excess Trash
Selectman Bice discussed a motion to request the Board of Finance to appropriate $2,500 to the Miami Beach Association to reimburse Miami Beach for the cost of excess trash removal.  During the recent budget cycle, Miami Beach Association requested $5,000 to assist in deferring the cost of trash removal, raking, and other related maintenance costs.  Many people using the beach are non-members of the Association and they leave trash after using the beach.  The town operates the parking lot at the beach which nets $15,000 to $20,000 per summer and some of the people who park there use Miami Beach.  There are now 30 pickups of trash three times a week.  Selectman Bice made a motion to request $2,500 from the Board of Finance to assist Miami Beach in the cost of removing trash from Miami Beach.  Selectman Sibley seconded the motion.  SO VOTED.

Peter Grimaldi, President of the Miami Beach Association, stated he appreciated the efforts of First Selectman Griswold and Selectman Bice to resolve the trash problems at Miami Beach.  He believes that Shoreline Sanitation should not request payment for trash pickup at the beach since they are taxpayers.  

6.  Public Comment:        
Resident Russ Carlo of Swan Avenue in the Sound View Beach area complained about the bars, trucks parked beyond the barricades in fire lanes, a shed with no permit erected on the beach by owners of the Pavilion, and a raft on the water with jet skis tied to it.

Resident Angelo Faenza requested the Board of Selectmen to act on enforcing the ordinance regarding parking lots.  On Sunday, he witnessed cars making U-turns, and pulling onto private property.  First Selectman Griswold asked Mr. Faenza whether the beach association could apply pressure on landowners who allow parking on private property.  Mr. Faenza spoke with his neighbor about this safety issue problem. Sound View Beach needs cooperation and enforcement by the Board of Selectmen.  He stated there should be better communication between towns, DEP, and police on the occasion when one beach closes causing extra traffic and people in neighboring town beaches.

Dennis Melluzzo of the Sound View Beach Association stated that he approached two unauthorized parking areas owners.  They know that before any action by Zoning can take place, the summer will be over and they have made their money without having a  permit.  The police did ticket illegally parked cars over the weekend.  He would like no parking signs be moved to the top of Hartford Avenue, Portland Avenue and Swan Avenue.  Mr. Melluzzo also agreed with Mr. Grimaldi regarding the trash pickup problems at Miami Beach.  

Selectman Bice stated that the Board of Selectmen should go before the Zoning Commission to clarify the rules and enforcement procedures so the ordinances can be enforced.

Resident Mary Hyland of Portland Avenue, whose property borders the town parking lot, states there are problems with intoxicated people, bottles being thrown, drugs and traffic.  She feels authorized personnel are needed on the weekends especially police on bicycles.

7.  Other Business:  
First Selectman Griswold stated he will be out of town at the time of the next scheduled Board of Selectmen meeting on July 15, 2002.  The Board agreed that the next meeting will be held on Monday, July 22, 2002 at 7:30 P.M.  

Selectman Sibley stated that advice from professionals on crowd control is needed.
8.  Adjournment:  
Selectman Sibley made a motion to adjourn at 9:38 P.M. The motion was seconded by   Selectman Bice.  SO VOTED.
